17. Community Development Block Grant - Southwood. To solicit input on a proposed Vibrant Communities
Initiative application submitted to the Virginia Department of Housing and Community Development for the
Southwood Redevelopment Project. Residents of the project area are encouraged to attend. The proposed funding
will support the installation of infrastructure and the development of fifteen homes in the first village of Southwood.
All beneficiaries shall be low-and moderate-income families. Citizens will also be given the opportunity to comment
on past uses of Community Development Block Grant funds by the County. (Ron White, Chief of Housing)
18. ZMA201700007 Hoqwaller Farm.The purpose of this public hearing is to consider and act on the Project, including
amended proffers submitted after the close of the public hearing held on the Project on August 1, 2018 to limit the
total square footage of farm sheds on the Project property to 600 square feet. PROJECT: ZMA2017-00007
Hogwaller Farm MAGISTERIAL DISTRICT: Scottsville TAX MAP/PARCEL(S): 07700000002000 LOCATION: East
side of Nassau Street near intersection with Florence Road; west side of Moores Creek across from Moores Creek
Treatment Plant. Adjacent to properties within the City of Charlottesville. PROPOSAL: Rezone property from Light
Industrial (LI) to Rural Areas (RA). PETITION: Rezone the 7.52-acre parcel from Light Industrial (LI) which allows

Conservation Easements Program)of the Albemarle County Code by: 1)amending§A.1-108(ACE ranking criteria)
pertaining to points awarded for streams and stream buffers; 2) amending § A.1-109 (ACE deed terms and
conditions) to require a stream buffer at least 35 feet wide along each side of perennial streams in future ACE
easements, to require livestock exclusion from streams (with certain exceptions), to define structures and uses not
permitted in the stream buffers,and to eliminate existing deed provisions for voluntary stream buffers;and 3)making

adoption of the following ordinance changes to the Albemarle County Code: Amend Section 18-5.1.47 to
establish regulations for by right farmers' markets including prohibitions on amplified sound and lighting,
limiting by right farmers' markets to twice a week, prohibiting by right farmers' markets from operating when
the primary use of the property is occurring, and limiting by-right farmers' markets to properties subject to
approved site plans pursuant to Section 18-32 and limiting parking to the parking areas shown on the
property's approved site plan; Amend Sections 18-10.2.-1, 18-11.3.1, and 18-12.2.1 to permit farmers'

list urban beekeeping as a by right use, and add Section 18-5.1.63 to establish supplementary regulations for
urban beekeeping to establish setback regulations for beehives, a warning sign requirement, prohibition of

equipment regulations, and establishing a maximum number of bee colonies pursuant to a lot's size. A copy

Dear Ms. Schweller,
On June 26,2018 the Albemarle County Planning Commission took the following actions and making the following
recommendations to the Board of Supervisors:
RECOMMEND,by a vote of(4:1),DENIAL of the Special Exceptions to sections 5.1.40(b)(2)(b)(size)and section
5.1.40(b)(2)(c)(projection)and section 4.2.5(disturbance of critical slopes)for the reasons outlined in the staff report as
unfavorable factors.
RECOMMEND,by a vote of(4:1),DENIAL of SP-2017-00026 for the reasons in the staff report identified as the
unfavorable factors to the request as follows:
1. The proposal fails to meet section 5.1.40(b)(6)of the ordinance because the location and height of the
monopole does not provide adequate opportunities for screening and the facility is not sufficiently sited to
minimize its visibility from adjacent parcels.
2. The proposal fails to meet section 5.1.40(b)(2)(b)of the ordinance because the size of the Shentel antenna
is larger than 1,400 square inches.This increases the bulk atop the tower,which increases visibility of a
highly visible tower.
3. ARB does not support or recommend approval of the facility.
4. Under FCC regulations if approved the monopole would be permitted to increase in height by 20 feet and
install antenna extending up to 20 feet from the monopole which would further increase the visibility of the
facility.
5. The facility is inconsistent with the Comprehensive Plan.
Please be advised that the Albemarle County Board of Supervisors will review this petition and receive public
comment at their meeting on September 12,2018.It is the Board of Supervisor's preference that a public hearing not
be advertised until all of the fmal materials for a zoning application have been received by the County and are
available for public review. Therefore any new or additional information regarding your application,including final
proffers if applicable,must be submitted to'our office at least twenty-three(23)days prior to your scheduled hearing
date,which is August 10,2018.

YOU OR YOUR REPRESENTATIVE MUST BE PRESENT AT BOTH OF THESE MEETINGS.
At least fifteen(15)days preceding the commission's public hearing,the Zoning Administrator or designee
shall erect on the property,subject to the above-referenced application(s),a sign(or signs)indicating the
property is to be subject to public hearing and referencing how to obtain additional information regarding
such hearing. The sign shall be erected within ten(10)feet of whatever boundary line of such land abuts a
public road and shall be so placed as to be clearly visible from the road. If more than one such road abuts '
the property,then a sign shall be erected in the same manner as above for each such abutting road. If no
public road abuts thereon,then signs shall be erected in the same manner as above on at least two
boundaries of the property abutting land not owned by the applicant. The filing of the petition or
application shall be deemed to grant consent to the Zoning Administrator or designee to enter upon the

Upon a finding by the Board of Supervisors that failure to comply with the posting requirements of this
section has denied the public reasonable notice of the public hearing,the Board may defer action on the
petition or application until reasonable notice by posting is.given.
The applicant shall exercise due diligence to protect the sign or signs erected,pursuant to section 33.8,
from vandalism and theft;maintain the sign or signs in the location or locations in an erect position as
placed by the Zoning Administrator or designee;and ensure that such sign or signs remain legible. Failure
to comply with these responsibilities may be grounds for the Commission or the Board of Supervisors to
defer action on the petition or application until there is reasonable compliance.
Any sign erected pursuant to section 33.8 shall remain the property of the Board of Supervisors. It shall be
unlawful for any person,except the applicant performing maintenance required by this section or the
zoning administrator or an authorized agent of either,to remove or tamper with any sign erected pursuant
to section 33.8. All such signs shall be removed by the Zoning Administrator or designee within fifteen
(15)days following the Board of Supervisor's final action on the petition or application or the applicant's
withdrawal of the petition or application.
