Sec. 14-221 Deferral of review of preliminary plat; when application deemed withdrawn. The review of, and action on,a preliminary plat may be deferred,and an application for a preliminary plat may be deemed withdrawn,as follows: A. Request to defer by subdivider.A subdivider may request that review or action on its application for a preliminary plat be deferred for a specified period up to six(6)months. If during the deferral period the subdivider does not request the agent to take action on the preliminary plat as provided in section 14-222 within six(6)months after the date the deferral was requested,the application shall be deemed to have been voluntarily withdrawn. B. Failure to submit revised plat. If a subdivider fails to submit a revised preliminary plat to address all of the requirements within six(6)months after the date of the letter from the agent as provided in section 14-220,the application shall be deemed to have been voluntarily withdrawn by the subdivider. Sec. 14-229 Deferral of review of final plat;when application deemed withdrawn.The review of,and action on,a final plat may be deferred,and an application for a final plat may be deemed withdrawn,as follows: A. The County will not require an easement in this case. VDOT(Joel Denunzio) confirmed today that the proposed ACSA water main will be located within a segment of the Reservoir Road right-of-way that is within the secondary system of state highways. In lieu of an easement from the County, ACSA may proceed by obtaining a land use permit from VDOT to install the lines. The plats may be withdrawn by written (email) notice with cc Bill Fritz and Greg Kamptner. I don't believe we had to meet all of these requirements on a previously approved plat. You didn't. If you notice there is no County Approval or Board Representative signature. I have attached the plat from Woodbrook that was approved and recorded Granted,they were recorded; yet,there is no County approval. Will the county sign the deed without obtaining the approval from Community Development? Generally, deeds of easement are signed by the County prior to Current Community Development approval. I have spoken w/Bill Fritz concerning these easement plats. As long as these plats remain under the application, they must be processed as required by the County Subdivision Code for easement plats. I have sent you the results of my review for each plat. There are omissions to the Code listed by section number which must be fulfilled prior to approval. Should the County Attorney or Bill Fritz advise me to proceed otherwise, I will make the appropriate concessions. If I may be of further assistance, please don't hesitate to call.
