Andrew,
1 . VDOT does not take exception to towers with fall zones within the right of way.
2. VDOT currently has no plans to cut any trees in this area. If they were to fall, or need to be
removed the private party could get a landscape permit to plant trees in the right of way. As long_as
they don't present a safety or maintenance issue for the road the permit would be granted.
Let me know if you have any other questions.

Hi Adam,
I wanted to check in with you about this application (SDP2018-27) in advance of next week's SRC meeting.
While the access for the site is through 5th Street Station, I had two other questions/concerns I was hoping you
could address in your comment letter.
1. Fall Zone within the VDOT right-of-way per
5.1.40(c)(3)<http://www.albemarle.org/upload/images/Forms Center/Departments/County Attorney/Forms/Al
bemarle_County Code Ch18 Zoning05 Supplement Regulations.pdf>.
2. The trees being used to screen the tower are almost entirely located within the VDOT right-of-way. As
' such, the applicant's ability to ensure maintenance/conservation of these trees is a concern. Would you be able
to address:
a. If there are any plans to remove/cut trees along the full frontage of 5th Street Station?
b. If the applicant would be allowed to replant individual trees within the right-of-way that die, likely
within a 100' radius of the tower?
Please feel free to give me a call if you have any questions.
