Charlottesville, VA 22901 (the "Property"), Owner — Commercial Rentals LLC, 1024 Carrington
Place, Suite 100 Charlottesville, VA 22901
Mr. Carter:
In response to your request for an Official Letter of Determination of use for the above
referenced Property, please be advised of the following:
• The Property is zoned CO, Commercial Office. The permitted uses of the Property are
provided in Section 23 of Chapter 18 of the Albemarle County Code ("Zoning
Ordinance"). The Property is subject to the Airport Impact Area, Entrance Corridor, and
Steep Slopes Overlay Districts as described in Section 30 of the Zoning Ordinance.
• A car wash is not a permitted use in the CO zoning district.
• The Zoning Ordinance defines car wash as "An establishment for cleaning motor
vehicles where the cleaning is performed using equipment, supplies and water provided
by the establishment. The use identified in this chapter as "automobile laundry" is a car
wash."
• As outlined in the following Sections of the Zoning Ordinance, car wash/automobile
laundry is a by -right use in the following zoning districts; Section 24 - HC, Highway
Commercial, Section 25 — PUD-SC - Planned Development - Shopping Center, Section
25A - PD-MC, Planned Development - Mixed Commercial, and Section 20 - PUD SC,
Planned Unit Development — Shopping Center, and by Special Use Permit (SP) in
Section 20B - DCD, Downtown Crozet District, and Section 26 - LI, Light Industry, and
HI, Heavy Industry zoning districts.
• Site plan development of the Property is subject to Chapters 17 and 18 of the Albemarle
County Code, Water Protection Ordinance and Zoning Ordinance respectively.
• Rezoning of the Property is subject to Section 33 of Chapter 18 of the Albemarle County
Code.
• Further details regarding specific proposals for development must be discussed with
staff at a scheduled Pre -Application Meeting.

If you are aggrieved by this determination, you have a right to appeal it within thirty (30) days of
this notice, in accordance with Virginia Code § 15.2-2311. If you do not file a timely appeal, this
determination shall be final and unappealable.
An appeal may be taken only by filing an appeal application with the Zoning Administrator and
the Board of Zoning Appeals, in accordance with Albemarle County Code § 18-34.3, along with
a fee of $258. Additionally, a separate fee is required for the cost of providing notice and
advertising of the appeal for a public hearing.
Applications for Appeal of the Zoning Administrator's Determination are available at the
Department of Community Development located at 401 McIntire Road, Charlottesville, Virginia
22902 or online at www.albemarle.org/cdapps. This form applies to the appeal of a decision of
the zoning administrator or any other administrative officer pertaining to the Zoning Ordinance.
Regulations pertaining to the filing of an appeal to the Board of Zoning Appeals are located in
Chapter 18, Section 34.3 of the Zoning Ordinance. They may be reviewed online at
