There has been some confusion with our Intake staff about townhouses and ARB review, so it may be that some permits
were approved without the required ARB sign-off.ARB review applies to parcels within the EC overlay district.That
includes 1) parcels that were adjacent to the street at the time the street was designated an Entrance Corridor and
includes the full depth of the parcel and 2) parcels that were not adjacent, to a depth of 500' from the right-of-way.
Subsequent subdivision does not change this, but if the ARB determines that a development (or portion thereof) will not
be visible from the street, then ARB review won't be needed for that development(or portion thereof). Also, note that
single-family detached residences do not require architectural design review.

For future reference, can you explain what is subject to review and what is not? Our other units did not get reviewed. I
thought the requirement was within 200' of the ROW.

Margaret—We are finishing up the package this afternoon. Do I need to submit lots 19-22 AND 23-26? Lots 23-26 are
not visible from the street and they are located more than 200'from the ROW. Shouldn't this be outside of the ARB
jurisdiction?

Margaret—Good morning. I hope you are doing well.
Scott Carlson and I are working on the Avinity TH permits. I wanted to answer your questions below, but I was also
hoping that you could provide more information on the process. Please give me a call at your convenience
(571.309.5043).
1) The developer has granted us ARB approval per the recorded Declaration. Is there also a County overlay or
process that we need to go through?
2) Confirmed—the front door faces Avinity Drive. We are rear loading all of these units from Avinity Place.
3) See below. Black is consistent with the original approval. Red is updated information. We added a few hardi
colors and a new shingle color. This should provide some variance throughout the community. All building
materials remain the same.
4) It will not be visible from Avon due to the grades. Please see attached plan for HVAC locations. We typically
install them under the deck in between the driveways. We install one end unit on the side (away from Avon
Street).

Subject:Avinity townhouse building permits
Scott,
I received your email address from Rebecca Ragsdale. She indicated that you would be the best person to contact about
the recent Avinity townhouse building permits. I have received the permits for townhouses 19—26. I have a few
comments/questions:
1. The architectural elevations included with the permits differ from the ARB-approved designs. I will need to take
the revised designs to the ARB for review. Please submit an ARB application for review. In Part B under"Review
by the Architectural Review Board" check the box for"Amendment to an approved Certificate of
Appropriateness". Be sure to include the corresponding checklist, all the checklist items, 8 copies of the
submittal items, and the fee.
2. Can you confirm that the fronts(not the backs) of the townhouse units face Avinity Drive?
3. I can't find complete material/color information on the drawings included with the permits. Can you confirm
that the building materials and colors match what was previously approved by the ARB? (I've copied below the
previously approved materials and colors.) If the materials/colors are different, I'll need samples. Please be sure
that the elevation drawings submitted with the ARB application call out all materials and colors.
4. Can you confirm that mechanical equipment (both building-mounted and ground-mounted) won't be visible
from Avon Street? Please indicate the locations of mechanical equipment on the drawings and show how
visibility will be eliminated.
