The zoning inspectors have approved the Turtle Creek sign location along Hydraulic Rd. They wanted to be certain to emphasize that the leg of the step-in sign closest to Hydraulic is at the setback line.The proposed location meets setbacks, but there can be no portion of the sign closer than that leg-no overhang. ARB is waiting on the landscaping plan. Planning is waiting on a letter of revision which updates the site plan to reflect the actual landscaping at the development. These need to occur before the sign permit is approved. The zoning inspectors are still processing the Commonwealth side. I believe it will benefit us to allow County field staff to take the lead on that review. I will follow up with them later this week. 2 ..r Give me a call if you'd like to talk through any of this. The lead edge of this marker represents the location of the lead edge of the proposed sign and is now set back 5 feet from the property line (determined from the property iron), as was depicted in the drawings supplied to the county. The edge of the marker is now in line with the edge of the original sign, which makes sense as the property line did not move in this location. I apologize that I misspoke regarding the compensation for the sign. After our months of discussion, it's easy to be focused on the landscaping. Even so, I'm sure you can appreciate that our costs continue to increase. To your point about the one sign remaining—the issue is that that is a one-sided sign,which is no longer adequate since the opposing sign has been removed. I'm not asking for any type of additional compensation really just some flexibility in the process in order to expedite the resolution here. I hope you can understand how unfair it seems to have to apply for an LOR when the changes to the site plan aren't yours, etc. To clarify, I am not at all disappointed in the sidewalk. Were the circumstances different, i.e., if Turtle Creek had simply, of its own volition, desired to update its signage and landscaping, I would have no objection to any of these requirements or even to the timeline described below. As is, however,the need for new signage is the result of the County's work, which eliminated Turtle Creek's signs. When the County acquired the easement for this project from Turtle Creek,the Association was given compensation for the landscaping that would be removed (and have to be replaced), etc., but they were not given compensation for their signage which was eliminated. Accordingly, I can hope that you understand how important it is that we minimize the costs that are incurred by the Association in this effort. Associations do not generate profit—they have only the income that they generate from home owners' dues. Every penny that we spend comes from the owners of the units at Turtle Creek, and we have a fiduciary duty to them to protect their investment and spend their funds appropriately. Throughout this effort we have endeavored to work closely with the County to have a successful project, and we want to continue to do so, but I cannot help feeling that as we endeavor to complete two basic tasks: 1. Install landscaping to replace that removed by the County and 2. Install signage to replace that removed by the County, we continue to meet resistance and face additional costs (LOR fee, surveying fee,time delays, etc.). The County has had surveyors out many times in recent months to layout their sidewalk, etc. Is it unreasonable to ask that they simply stake the items necessary to provide your teams the information that they need to grant us approval? Has the sidewalk on this side of the road been staked yet? Can all of this be done at once? Rather than incurring additional costs for a temporary sign, I ask that the County consider granting conditional approval for this installation UPON COMPLETION of the County's sidewalk. Provided the County constructs its sidewalk as drawn, I don't see why this would be a concern. It is our goal to minimize the amount of time between the completion of the County's work and the installation of our new signage, and I would appreciate any feedback from you all as to how to accomplish this. We will be submitting our LOR very shortly. I look forward to working together to find a solution that is most efficient for all involved. The marked location of the proposed sign appears to be located in the temporary construction right-of-way. Staff will not be able to approve the sign location until the sidewalk construction is completed. A potential solution to the problem of being without one sign would be to post a temporary sign that could remain in place throughout the sidewalk project. 9 w• Temporary signs can be approved quickly and do not require approval from the Architectural Review Board. Please let me know if you are interested in pursuing that option. For the new permanent sign, it is the applicant's responsibility to provide documentation for the edge of the right-of- way. Documentation can be provided in two ways: 1. A surveyor can stake the location of the right of way in the field (from which the Code Compliance Officers can physically measure the required setback) Or 2. A surveyor can provide us a worksheet showing the location of the R.O.W. as was physically staked in the field (this document would then also need to show the staked location of the proposed sign). At this time, the Architectural Review Board (ARB) staff still await the submission of the landscaping plan (Letter of Revision). The Zoning Code Compliance Officers will await the required documentation from a surveyor. Once the ARB review has been approved,the required documentation from a surveyor has been submitted to Zoning staff, and the sidewalk has been constructed on the parcel in question, we will move forward with the preliminary zoning inspection. Every penny that we spend comes from the owners of the units at Turtle Creek, and we have a fiduciary duty to them to protect their investment and spend their funds appropriately. Throughout this effort we have endeavored to work closely with the County to have a successful project, and we want to continue to do so, but I cannot help feeling that as we endeavor to complete two basic tasks: 1. Install landscaping to replace that removed by the County and 2. Install signage to replace that removed by the County, we continue to meet resistance and face additional costs (LOR fee, surveying fee, time delays, etc.). The County has had surveyors out many times in recent months to layout their sidewalk, etc. Is it unreasonable to ask that they simply stake the items necessary to provide your teams the information that they need to grant us approval? Has the sidewalk on this side of the road been staked yet? Can all of this be done at once? Rather than incurring additional costs for a temporary sign, I ask that the County consider granting conditional approval for this installation UPON COMPLETION of the County's sidewalk. Provided the County constructs its sidewalk as drawn, I don't see why this would be a concern. It is our goal to minimize the amount of time between the completion of the County's work and the installation of our new signage, and I would appreciate any feedback from you all as to how to accomplish this. You'll see that I've highlighted the existing right-of-way as either yellow or orange; it generally follows the curb, but sometimes it followed the north side of the sidewalk. However, the new right- of-way line (highlighted in blue in both drawings) pushes that edge further north. Please use the blue lines, which is the proposed permanent (new) right-of-way edge as your reference point when locating the new signs. I hope this helps. However, when I started to add the position of the signs to the site plans that you've provided, I found that I was not sure which line I should be measuring the setback from. While on site, I measured from the edge of the pavement (highlighted in yellow in attached drawing). Although, I have found from reviewing Albemarle County code that I should have been measuring from the property line or access easement edge. I think that the line that I have highlighted in red is this edge,but I am not sure. To add to my confusion, I had previously found a proposal for the sidewalk construction that shows the right of way edge moving at that location. Can you please clarify where the setback needs to be measured from? So just to make sure—can we submit for the replacement landscaping we plan to install as a letter of revision. If the sign location is moving, I would also include the sign position (this could kill two birds with one stone,too, because if the site plan is drawn to scale, Zoning staff can measure the distance of the proposed location for the new sign from the VDOT right-of-way,which is a requirement in the sign application as well as the landscape plan). No, I'm afraid I didn't know that this sign update was prompted by the necessity to accommodate a new sidewalk as per the County's requirement/request;there are many projects going through our offices at the moment, and we are, unfortunately, not always aware of all of them. But there are regulations about Outdoor Lighting(Ch. 18, Section 4.17) in the Albemarle County Code that the applicant must be taken into consideration (as well as Entrance Corridor criteria and standards regarding outdoor lighting, which can be found in the EC Design Guidelines) when making those choices. If you use LED fixtures, you must ensure that they don't emit over 3,000 lumens, which is a measure of illumination intensity. For your reference, 3,000 lumens is also equal to these alternate measures of light intensity: 3000 lumens= incandescent 160 w quartz halogen 160 w(white) fluorescent 35 w mercury vapor 75 w(blue) metal halide 40 w(white) hi press sodium 45 w(pink) to press sodium 25 w(yellow) Your electrical permit will require that you also submit manufacturer's specifications (or cut sheets)that need to have this information, so that we can verify that the level of illumination does not exceed the cap of 3,000 lumens in the EC overlay district. You are correct—ARB only has purview over the proposed sign on Hydraulic Road, which is the EC—not the one proposed on Commonwealth Drive; however,your sign permit is reviewed by other County employees besides ARB staff (including Zoning staff and Building inspectors), so the request should be kept together in one permit; I just won't sign off on the Commonwealth Road sign drawing, because it's not within our purview. So, no, you don't need to separate them out. But it does appear on the sign drawings (pages 3 and 4 of 5 total) that were submitted that both signs are located closer to the street—and the signs which you propose to take down are still in the drawings, adjacent to the superimpositions of the proposed new models. As you know, all of this is prompted by the County's removal of our existing sign to accommodate the County's sidewalk, so we're just trying out best to adapt to what will be left when the County's contractor pulls off. I appreciate your helping us with this project. 3 Can you provide the pages of the site plan that pertain to Commonwealth? If so,we will gladly verify that what is in place is consistent with the plan. We have only managed Turtle Creek since 2012, and this site plan is from many years prior to that, but I expect we'll be very close. We are not intending to make any revisions to the landscaping on Commonwealth Drive. Does the County have a light spec that it prefers? I would be fine going back with the lights that are currently in place (which I think is permitted under our agreement with the County for the construction easement for the sidewalk). If you would prefer to see a different type or style of fixture, I'm happy to consider that as well. My preference would be an LED fixture to reduce costs, but I really would just like to make this as easy as possible, so please let me know your thoughts. Heather, is the Commonwealth Drive sign subject to ARB approval? If not, perhaps we should separate these permitting processes? Sean,can you confirm if we are proposing a new location for that sign? I seem to recall that in that instance we're in the same location.
