THE APPLICANTS REQUEST RELIEF FROM THE FOLLOWING SECTIONS:
(1 ) SECTION 2-5-1 TO ALLOW THE EAST PROPERTY SIDE TO BE 9 FEET; A
VARIANCE OF 16 FEET; AND
(2) SECTION 2-6-2 TO ALLOW THE WEST PROPERTY SIDE FRONTING ON RTE.
711 TO BE 26 FEET; A VARIANCE OF 4 FEET.
ZONING ORDINANCE REQUIREMENTS
(1 ) SECTION 2-5-1
SIDE. THE MINIMUM SIDE YARD FOR EACH MAIN STRUCTURE SHALL BE
TWENTY-FIVE (25) FEET OR MORE.
(2) SECTION 2-6-2
THE SIDE YARD ON THE SIDE FACING THE SIDE STREET SHALL BE THIRTY (30�
FEET OR MORE FOR BOTH MAIN AND ACCESSORY BUILDINGS.
STAFF RECOMMENDATION
STAFF RECOMMENDS DENIAL BECAUSE THE PROPERTY LINES WERE STAKED AND
INSPECTED BY THE ZONING INSPECTOR AND VIEWED BY THE CONTRACTOR AND OWNER.
THE HOUSE WAS THEN CORRECT BY THE ORIGINAL SURVEY.
A NEW SURVEY HAD TO BE MADE WHEN THE HOUSE WAS PUT UNDER CONTRACT. AFTER
THE NEW SURVEY WAS COMPLETED, THE PROPERTY LINES WERE RELOCATED TOO CLOSE
TO THE HOUSE. STAFF FEELS TH►S WAS NO FAULT OF THE INSPECTOR BUT THE
SURVEYOR.
