Dear Mr. Vaughn: As a long-time member of the Scenic Highway Committee of Citizen for Albemarle, with a special interest in Route 250 West, I am concer ed about the request for a variance for a new sign on the Brownsville 1 Market. I concur that the Brownsville Market needs improved identification, but the improvement might come from reducing the number of signs rath4r than from adding an additional one. Already the place is cluttered with signs proclaiming the availability of Gulf, Coca Cola, Dr. Pepper, diesel fuel, etc. , so that the market's name is subordinated to advertis- ing for soft drinks. The clutter is compounded by the mixture of lighl,ed signs and unshielded light fixtures, so that at night -- which happens to be the time when we most frequently stop there-- the eye is distracted by many lights. 1 I request that you give consideration to the matter of safety, a4 I understand that the variance would permit a free-standing sign of faintly large size at a considerable height. When last observed, the market hied no directional markings for traffic, and customers' cars entered, par*ed, and left at random angles. Already this condition presents problems or customers entering (as we usually do) from a left turn, particularly at night. If some driver tried to avoid another car and accidentally backed into a free-standing sign standard, a large sign could cause serious dam age by falling on car and occupants. My final concern is with the aesthetics of a business on the hisiori. old traffic route that is one of the tourist attractions of AlbemarleCou ty. The Brownsville Market is in a location to impress visitors with a worthy , dignity and charm, and an unconsidered proliferation of catch-penny signs ) will not foster the growth potential that a market in that locality could command. Vaughn, Zoning Administrator Reference: VA 79-77 : Please if possible read at meeting With regeerd to the variance requested, we of course are aware that the Brownsville Market was in existance long before the adoption of the Albemarle County Scenic Roads Ordinance. However, we would like to make the following comments with regard to the requested variance : 1.There is at the present time considerable and varied sign space at this site. It would be difficult for any- one to take in all the signs while traveling at reasonable speed,along Route 250 west. 2.It is therefore difficult for us to see the need for yet another sign on this site, and one in excess of the permitted. signage under the scenic roads ordinance. 3.In addition we would like to point out a safety concern related to the setback variance because of the specific characteristics of the site. The parking area at this store is not defined. with regard. to entrances and exits, and a free standing sign close to the road could make entrance and exit tOrecoftfusing than it is at present. To sum up, as you know there has not yet been a variance on Route 250 west with regard to the size of a free standing sign, although there have been variances with regard to, set- backs. We have been pleased by the concern exhibited by the Board of Zoning Appeals about these matters, and pleased toowith the careful and attractive design of the new signs that have been. erected along 250 west. We ask you to consider carefully whether another sign is warranted at this heavily signed site. We appreciate the concern with which you approach our con- cerns. This sign is in violation of the size requirements (maximum allowable size is twelve (12) square feet in area) , height regulations (shall not exceed ten (10) feet in height above ground level ) , and setback regulations (minimum of fifty (50) feet from the right-of-way of Route 250, a scenic highway) . Also, you do not have a sign permit for this sign. If you choose to have this sign at this location, then you must apply for a variance and be heard before the Board of Zoning Appeals. James Rea Tax Map: 55B Parcel : 19 Zoned: B-1 Existing Activity Country Store Proposed Variance The applicant requests relief from section 18-3-5 of the Albemarle County Zoning Ordinance to allow a business sign (freestanding) of 33 square feet; a variance of 15 square feet; relief from section 18-3-5 to allow a free- standing business sign at 15 feet above ground level ; a variance of 5 feet and relief from section 18-3-2 to allow a freestanding business sign to be located 4.5 feet from the right-of-way of Route 250; a variance of 45.5 feet. Zoning Ordinance Requirements Section 18-3-2: For purposes of this Article, no sign except those signs defined in Sections 16-80-6, 16-80-7, 16-80-10, 16-80-11 , 16-80-12, 16-80-16, 16-80-17, 16-80-18, and 16-80-19 of this Ordinance shall be located within fifty (50) feet of the right-of-way of any designated scenic highway or Virginia byway having a right-of-way width of fifty (50) feet or more, nor within seventy-five (75) feet of the right-of-way of any such highway or byway having a right-of-way width of less than fifty (50) feet. Section 18-3-5: All sign subject to the provisions in Article 18 of this Ordinance shall conform to the regulations of Article 15A of this Ordinance except where specifically provided as follows: B. Commercial Office (CO) District and General Business (B-1 ) District. 1 . Business Signs (Free-standing or projecting) : One (1 ) free-standing sign or one (I ) projecting sign per establishment per road frontage. Each sign shall not exceed eighteen (18) square feet in area nor exceed ten (10) feet in height above ground level , with lesser heights being encouraged. James Rea Page 2. the west side of the building. It would be blocked by a single-family dwelling on the west side if setback the required distance. On the east side it would be blocked by the fruit stand and if located on the east side of the fruit stand it would also be located on the State right-of-way. The sign is located 49 feet from the edge of pavement. As for the height and size, the staff feels like a 18 sq. ft. sign (scenic highway requirements) can properly identify the business. Also, the sign can be limited to 10' in height (scenic highway requirements) and properly identify the business.
