Dear 1'lr. Hurt:
Enclosed is a partial plat of our Charlottesville property. I
have attempted to spot the sign as accurately as possible. The
following notes are appropriate:
1 ) The curb line lies as indicated by the thick
black line, 22 feet from the edge of the
existing road.
2) The sign is located 7 feet off the existing curb
line.
3) The sign' s dimensions are 5'l0" wide and 4'6"
high, exclusive of the shingled roof.
We appreciate your rescheduling of the hearing on this matter.

Dear Mr. Hurt:
This will acknowledge receipt of your letter of
March 18, 1980, relating to the Weinstein Management
Co. , Inc. , request for certain relief in Tax Map 61,
Parcel 129D.
I cannot attend the public hearing to be held by
the Board of Zoning Appeals on March 25 because I have
suffered a stroke. I do, however, wish to protest
herewith in writing against any variance whatsoever.
The County of Albemarle has adopted a very fine zoning
code and I believe it should be strictly enforced.

Dear Mr. Hurt:
Let me take this opportunity to thank you and the members of the
Board of Zoning Appeals for your cooperation at our meeting this
week.
It is our understanding that the currrent location of the sign is
acceptable provided we reduce the size to twelve square feet. In
addition, we understand that the location of the sign will come under
annual administrative review by your department with respect to the
proposed widening of Rio Road.
We will commence construction of a new sign and removal of the old
one should be complete within thirty days.
Again, we appreciate everyone's time and assistance. If you have
any questions, please let us know.

Proposed Variance
The applicant requests relief from section 6-3-1 of the Zoning Ordinance
to allow a free-standing sign to be located 11 feet from the right-of-way;
a variance of 19 feet and relief from section 15A-5-5 to allow an identi-
fication sign to be 24 square feet; a variance of 22 square feet.
Zoning Ordinance Requirement
6-3-1 All structures, except signs advertising sale or rent of the
property, shall be located thirty (30) feet or more from any
street right-of-way.
15A-5-5 Identification Signs: Provided: (a) not more than two (2)
square feet in area; (b) not more than one (1 ) on any lot or
premises.
Staff Recommendations
Unless the applicant can show a demonstrable hardship, the staff recommends
denial regarding the size of the sign. If the Board chooses to approve the
variance for the setback, the staff would recommend that the sign be limited
to the size specifications of the ordinance.

Dear Mr. Hurt:
Enclosed is our applicaton for a variance for the sign located on Rio
Road for the above referenced property.
You have advised us that a hearing on this matter is scheduled for
March 11 , 1980. This letter is to request a postponement of a hearing
on this matter for the following reasons:
For several months now, our Company has had a training seminar scheduled
here in Richmond for all rental office personnel . This involves the
various properties managed by Weinstein Management Co. , Inc. ranging
from Harrisonburg through Hampton and Newport News. We have scheduled
outside speakers, films, and presentations from staff personnel . It is
critical that I, as chief operating officer of Weinstein Management Co. , Inc. ,
be present at that all day session.
In order to adequately present our request for a variance, I wish to
personally be present at the hearing. This would allow questions from
the personnel at the hearing to be directly answered by me. I have found
in such situations that the personal contact is advisable whether or not
the variance is approved.
Therefore, due to the conflict, we have requested the postponement.
