The applicant seeks relief from section 18-3-2 of the Albemarle County ;,
Zoning Ordinance to allow a free-standing business sign to be located
42 feet from the right-of-way; a variance of 8 feet.
Zoning Ordinance Requirements
18-3-2 For purposes of this Article, no sign except those signs defined
in sections 16-80-6, 16-80-7, 16-80-10, 16-80-11 , 16-80-12, 16-80-16,
16-80-17, 16-80-18, and 16-80-19 of this ordinance shall be lcoated
within fifty (50) feet of the right-of-way of any designated scenic
highway or Virginia byway having a right-of-way width of fifty (50)
feet or more, nor within seventy-five (75) feet of the right-cf-way
of such highway or byway having a right-of-way width of less than
fifty (50) feet.
Staff Recommendations
If the sign was installed at the required setback, the sign would not be
visible when traveling east or west on Route 250 because this sign would
be located between two buildings. A 28 foot variance was granted to the j
previous occupant for a sign setback but the setback at that time was
30 feet. Since that time, a scenic highway provision was adopted requiring
a 50 foot setback. The applicant would have to comply with the Scenic
Highway requirement. Also, a 30 foot variance was granted to the adjoining
property owner which was know at that time ad Country Antiques. Therefore,
the staff does see that a hardship exist and must recommend approval .

The following action was taken by the Board of Zoning Appeals
at their rjleeting of May 6 , 1975. �..
VA-75-12. Calico Cat-Wanda Johnson requests a 28 -ft
variance from the required 30 ft. setback for a business sign
in B--1 Zone. Property is located on the south side of Route
250 West, approximately 4 mile from intersection of Routes
250 and 797 ; and is further described as County Tax Map 55 ,
Parcel J10 . This variance was granted with the following
conditions : a) granted for the present occupant, to cease •
with the occupant; b) granted for one (1) year with administrate
tive approval annually after this one (1) year period.
2) VA--75-14 . Ivy Land Company is requesting an area
variance of . 478 acre from required 2 . 0 acre requirement in
A-1 Zone; property located on northeast quadrant of inter-
section of Route 601 and Route 676 and is further described
asTax Map 43, Parcel 29 , part of and 29B, Jack Jouett Distri '.

.3) VA-75-15. Clarence & Rosa Powell are requesting a
10 foot variance from the sidcyard setback of Route 20 south' ''
approximately 1 mile from Marshall Manor; further described
as County Tax Map 102 , Parcel 11A, containing . 94 acre in
Scottsville District. The Board of Zoning Appeals granted
the variance on the condticn that the souther side of the
lot meets the required 25 foot sidcyard setback.
