Mr. Thacker informed me that you needed a variance for this porch since the porch is only fifty-one feet from the right-of-way of Route 630. The setback requirement in an A-1 zone is seventy- five feet. The deadline for filing for this variance is March 24, 1980, in order for the variance to be heard before the Board of Zoning Appeals on April 8, 1980. Proposed Variance The applicant seeks relief from section 2-3 of the Albemarle County Zoning Ordinance to allow a porch to be 51 feet from the right-of- way; a variance of 24 feet. Zoning Ordinance Requirement All structures, as herein specifically defined, shall be located a minimum of seventy-five(75) feet from any street, road, or access easement. Staff Recommendation No permit was obtained from the County before installing deck.
