Sunny Hill Land Trust (Virginia National Bank) Tax Map: 061 Parcel: 120S(part of) Zoned: B-1 Existing Activity Old Sunny Hill Motel (not occupied) Proposed Variance The applicant requests relief from section 7-2 of the Albemarle County Zoning Ordinance to allow a drive-in bank to be constructed on a lot consisting of 34,010 square feet, a variance of 5,990 square feet. Zoning Ordinance Requirement There shall be no minimum area requirements for permitted uses, except as herein otherwise expressly provided. In the case of any parcel served by either a central sewer system or a central water supply, there shall be provided a minimum area of forty thousand(40,000) square feet per commercial or industrial establishment or per dwelling unit, as the case may be. Staff Recommendation The Albemarle County Planning Commission, at its meeting on January 23, 1979, approved this plat subject to certain conditions. One of those conditions was Albemarle County Service Authority approval of water and sewer plans. The intent of this is that the applicant connect to public water and sewer. Anything con- trary to this would violate the conditions that the Planning Commission set. Based on these conditions the staff must recommend denial. Acreage: 1+ acre Zoning: B-1, Commercial Proposal: Subdivision plat showing three parcels, 25,650 square feet, 20, 175 square feet, and 34,010 square feet, to be served by public water and sewer. Staff Comment: This plat appears to meet the requirements in the Subdivision Ordinance and therefore Staff recommends approval subject to the following conditions: Recommended Conditions of Approval: 1.
