Salasco Service Corporation Tax Map: 61W1 Parcel : A22 Zoned: R-3 Existing Activity Single Family dwelling Proposed Variance The applicant requests relief from section 6-3-1 of the Albemarle County Zoning Ordinance to allow a structure to be located 28 feet from the front property line; a variance of 2 feet. Zoning Ordinance Requirements All structures, except signs advertising sale or rent of the property, shall be located thirty (30) feet or more from any street right-of-way. Staff Recommendation A plat was submitted to the County when the owner applied for a building permit. The setback shown on the plat met the requirements of the Zoning Ordinance. Steps attached to a structure do not have to meet the setback requirements. Porches and stoops over 8" in height have to meet the setback requirement and are considered as part of the structure. At the time the preliminary zoning inspection was made, the house was in compliance with the setback requirements. A stoop was added later causing the structure to be too close to the right-of-way. This stoop was not shown on the original plat. Therefore, the staff must recommend denial . $20.
