Dear Mr. Lengefeld,
This is a follow up of our telephone conversation of yesterday
concerning the above matter.
My recommendation to the Board would be for approval. The steep
topography of the land to the south of the stream would not be suitable
for a structure. The area directly beside the stream would be in the
floodway area of the stream. The only suitable place that a structure
can 'be built and get the use of the lot would be the area to the north
of the stream and cn the slope.
If you locate the structure in the area north of the stream, you i
would have to reapply for a variance.

County Zoning Ordinance to permit a structure to be located at
30 feet from the rear property line; a variance of 20 feet.
Zoning Ordinance Requirement
3-3-3: Rear yard shall be a minimum of fifty feet.

Staff Recommendations
This property is divided by a stream. The land to the south is
steep and in the flood area of the stream. Therefore, the staff
recommends approval of a variance of 20' to allow the structure
to be 30' from the rear property line.

Re: Setback Variance for Lot #37, Terrybrook Subdivision
Dear Mr. Hurt:
On April 16, 1979, I purchased the above lot from Preston Stallings, builder
with the intention of eventually building on the lot. Mr. Stallings stated
that a health permit had been issued for construction of a 3 bedroom
house on the lot. Mr. Stallings also stated that a 40 foot setback was
the county's requirement. Since then I've learned that the latest
requirement is 50 feet from the 10 foot Vepco easement. This would
place the house at the lowest elevation of the lot which is below the
overflow provision for lot #36.
Therefore please accept this letter as my request for a hardship variance
to locate the bulking line 30 feet from the back property line of lot #37.
The 30 foot building line would enable location of the house on the
higher elevation of the backside of the lot.
For your convenience, attached are two copies of the plat showing the
present requirements and the requested variance requirements. Your kind
attention is greatly appreciated.
With your approval, I am confident that this lot can become an attractive
homesite and an asset to the Terrybrook meighborhood.
