Proposed Variance
The applicant requests relief from section 2-6-2 of the Albemarle
County Zoning Ordinance to allow a structure to be located at 10
feet from the right-of-way of Route 231, a side street; a variance
of 20 feet. The applicant also seeks relief from section 2-5-2 to
allow a structure to be located at 5 feet from the rear property
line; a variance of 30 feet.

The side yard on the side facing the side street shall be thirty (301

To locate the unit any further back from the right-of-way would
cause undue hardship. The underground cable runs parallel to
Route 231 and 10 feet from the right-of-way of Route 231. Under-
ground cable does not require a variance but this unit would have
to meet the setback requirements because it is classified as a
structure. The intent of the utility companies is to keep this
underground cable as close as possible to the right-of-way without
intruding too much on thehe propertyre ner and an limiting,the use of
