James Manley Tax Map: 061K-05 Parcel: lA Zoned: B-1 Existing Activity Vacant (Old 7-11 location) Proposed Variance The applicant requests relief from section 7-3 of the Albemarle County Zoning Ordinance to allow a free-standing sign to be located 15 feet from the right-of-way of Route 743; a variance of 15 feet. Zoning Ordinance Requirement All structures except signs advertising sale or rent of the property, shall be located thirty (30) feet or more from any street right-of-way. Staff Recommendations A concrete pedestal is in place where a non-conforming sign was installed, which has since been removed. This pedestal contains wiring for an illuminated sign. If the sign was installed any further back from the right-of-way, then it would not be visible when traveling east on Hydraulic Road. Also if the sign was installed any further back from the right-of-way and the owner wished to have an illuminated sign, part of the concrete parking lot would have to be torn up so the wiring could be installed. Since a non-conforming sign was once in place, the staff would recommend approval for the sign to be installed in the same location as the non-conforming sign was. $20.
