The applicant requests relief from section 2-3 of the Albemarle
County Zoning Ordinance to allow a structure to be located at
15 feet from the right-of-way of Rt. 614; a variance of 60 feet.
Zoning Ordinance Requirement
All structures shall be located a minimum of seventy-five (75)
feet from any street, road, or access easement.
Staff Recommendations
The applicant could easily install the structure at 45 feet from
the right-of-way and only need a 30 feet variance. For proper
site distance and safety, and due to the fact that the structure
was partically built without the necessary permits, the staff
must recommend denial.
