Proposed Variance
The applicant requests relief from Section 15A-3-2 of the Albemarle
County Zoning Ordinance to allow an identification sign to be 32 square
feet; a variance of 30 square feet. Also, the applicant requests relief
from Section 4-3 of the Albemarle County Zoning Ordinance to allow a
sign to be located at 2 feet from the right-of-way; a variance of 28 feet.
Zoning Ordinance Requirement
Identification Signs shall not be more than two(2) square feet in area.
All structures, except signs advertising sale or rent of the property,
shall be located thirty(30) feet or more from any street right-of-way.
Staff Recommendations
Churches are permitted by right in the A-1 zone and all residential zones,,
Churches are considered as commercial structures' and are classified as a
business. The Sign Ordinance is more restrictive in the residential
areas and restricts the signs to much smaller sizes in the residential
areas. The residential zones do not allow a free-standing business- sign.
This sign would have to be classified as an identification sign and
limited to 2 square feet in size in the R-1 zone. Limiting the size of
this sign would make the sign unnoticeable. The right-of-way on Route
631 at this location is 45 feet from the center line of the road. The
applicant would have to set his sign another 30 feet from the right-of-
way line, making the sign unnoticeable.. Based on these facts-, the staff
must recommend approval.

This will acknowledge receipt of your letter of
October 6 regarding Northside Baptist Church's
application for relief from sections 15A-3-2 and 4-3.
Because I am a stroke victim I am unable to attend
the public meeting by the Board of Zoning Appeals to be
held on October 14th.
However, I do want to register in writing my protest
for any variance in zoning or signs on my property.
There is no reason for the variance requested. The County
of Albemarle has adopted a fine zoning code and I believe
it should be strictly observed.
