THIS AGREEMENT made this 18th day of August, 1980, by
and between Edward J. Woodhouse and Peggy L. Woodhouse, Sellers,
and Michael Underhill and Marylaure Underhill, Buyers
W I T N E S S E T H :
1. That for and in consideration of $1,000.00 cash paid
to the Sellers, the receipt of which they hereby acknowledge, the
Sellers promise to sell and the Buyers promise to buy that certain
tract of land with the improvements thereon situate in Albemarle County,
Virginia, in Batesville on State Route 692, containing 1.2 acres as
shown as Lot 2 on a plat of G. R. Randolph dated June 12, 1963,
recorded in Deed Book 391, page 279.
2. The purchase price is $49,500.00, payable as follows:
$ 1,000.00 Deposit paid with this contract; refundable only in
the event title to the property to be conveyed is
found to be unmarketable.
$48,500.00 Cash at closing
$49,500.00
3. Closing shall be on December 15, 1980, at the offices
of Muller and White, p.c.r 500 Court Square, Charlottesville, Virginia,
22901.
Included in this contract of sale as part of the con-
sideration shall be the conveyance to the Buyers of the stove, refri-
gerator, antenna and heating fuel now located on the property.
5. The Sellers agree to lease to the Buyers the property
to be conveyed for a term beginning September 1, 1980, and to end
i!on the date of closing for a rent of $400,00 per month to be pro-rated
for any portion of a month the lease is in effect. The rent is to
jibe paid monthly in advance and any rebate of rent due the Buyers
for the month in which the conveyance is made shall be reflected
in the closing statement as a such.
6. The Sellers agree to maintain a policy of fire and
bex.tended coverage insurance (U.S.A.A. Form No. 527-•1F10 (10-68) Ed.
111--79 or better) on the property until the closing date and assume
hint disk of loss by hazards as would be covered by such policy.

The Buyers assume the risk of loss by hazard and perils not covered
thereby. In any event, the Sellers assume all risk of loss to the
date when the Buyers take actual possession of the property.
7. Taxes shall be born by the Sellers through the lease
term and prorated as of the date of closing. The Sellers shall prepare
the deed and pay their share of the recording taxes.
8 The property shall be conveyed by a general warranty
deed with English Covenants of Title. The Sellers shall have a.
reasonable time from the stated closing date to correct any defects
in the title that make the property unmarketable. If such defects
cannot be corrected within a reasonable time, then the deposit shall
be returned to the Buyers and this contract voided. The lease may
continue on a month to month basis.
9. The Buyers have inspected the property, including
termite inspection, and agree to take actual possession in its condition
as of the date of this agreement.
10. Buyers agree that no renovation, alteration or other
modification to the existing improvements will begin before closing
is completed.
11. This document contains the entire agreement between
the parties

The applicant requests relief from Section 2-3 of the Albemarle County
Zoning Ordinance to allow a workshop/storage building to be located
13 feet from the right-of-way; a variance of 62 feet.
Zoning Ordinance Requirement
All structures shall be located a minimum of seventy-five(75) feet from
any street, road, or access easement.
Staff Recommendations
There is a level area at the end of the driveway where the workshop could
be located and not need a variance. Therefore, the staff must recommend
denial.
