Hurt Deputy Zoning Administrator 414 East Market Street Charlottesville, Virginia 22901 Dear Jesse: I am writing you concerning the set back problem on Lot 9, Rio Heights Subdivision. I still own fourteen lots and/or houses in Rio Heights and two of them adjoins either along a property line or at a corner with Lot 9. I strongly believe that a variance should be given the Pontons , so they can build their carport. There is a service drive between Lots 8 and 9 which automatically gives more space between the two lots; probably if checked, you would find in excess of the proper set back if you measured to the center line of the drive. The house looks good on the lot and will still look good and will not appear by the eye to be crowding the property line after the addition. In many instances, corner lots are really hurt by a written restriction as to set backs. I have always been a believer that corner lots have to be considered individually, as to set backs, in order to maintain a good appearance and serve purposes within reason. I would appreciate it if you would present these facts when considering this problem of the Pontons. If I can be of further help, do not hesitate calling me.
