Proposed Variance
The applicant requests relief from section 5-3-1 of the Albemarle County
Zoning Ordinance to allow a gazebo to be located on the common area at
the right-of-way; a variance of 30 feet.
Zoning Ordinance Requirement
All structures, except signs advertising sale or rent of the property,
shall be located thirty (30) feet or more from any street right-of-way.
Staff Recommendation
The gazebo will be located in the common area of the subdivision. This
structure could not be located any further back from the right-of-way
without part of of it being located on Lot 1, Block A. Therefore, the
staff recommends approval.
