Trail Tax Map: 046A Parcel: A8 Zoned: R-1 Existing Activity Single Family Residence Proposed Variance The applicant requests relief from section 4-7-2 of the Albemarle County Zoning Ordinance to allow an addition to be located at 19 feet from the right-of-way of Rt. 1438; a variance of 11 feet. Zoning Ordinance Requirement The side yard on the side facing the side street shall be thirty (30) feet or more for both main and accessory buildings. Staff Recommendations When this structure was erected there was a thirty foot access easement. The access easement was later brought up to state standards, therefore, requiring a 50 foot right-of-way making the structure closer to the right-of-way. A new survey was done showing a 50 foot right-of-way. By extending the structure on the end making the carport larger would make the front at the north end of the structure too close to the right- of-way. The staff does see that a hardship exists, and must recommend approval. $20.
