Tax Map: 061W2 Parcel: 38 Zoned: R-4 Existing Activity Single Family Residence Proposed Variance The applicant requests relief from Section 15.3 of the Albemarle County Zoning Ordinance to allow a single-family dwelling to be located 8 feet from the side property line; a variance of 2 feet. Zoning Ordinance Requirement Pursuant to Section 15.3, all structures shall be located ten(10) feet or more from the side property line. Staff Recommendations A plat was submitted to the County when the owner applied for a building permit. The setback on the plat met the requirements of the Zoning Ordinance. At the time the zoning and footing inspection was made, the house was in compliance with the setback requirements. The owner verified that the stakes that were set was the location of the property line. When a final survey was made it was found that the original stakes that were !, set were not correct.
