Proposed Variance
The applicant requests relief from section 13 . 3 of the
Albemarle County Zoning Ordinance to allow a single-family
dwelling to be located 13 feet from the side property line ;
a variance of 2 feet .
Zoning Ordinance Requirements
Pursuant to Section 13 . 3 , all structures shall be located
fifteen ( 15) from the side property lines .
Staff Recommendations
The present ordinance which was adopted on December 10 , 180 ,
requires a 15 foot setback from the side property line in
the R- 1 zone . The previous ordinance under which the lot
was recorded required a 10 foot setback to the side property
line . This structure could meet the setback requirements
under the previous ordinance but could not meet the
requirements of the present ordinance without reducing
the size of the structure . Based on the facts , the staff
must recommend approval .
