History Land Homes Tax Map : 045 Parcel : 11X Zoned : RA Existing Activity Vacant Land Proposed Variance The applicant requests relief from section 10 . 4 of the Albemarle County Zoning Ordinance to allow a single- family dwelling to be located 30 feet from the front property line ; a variance of 45 feet . Also , relief from section 10 . 4 to allow a dwelling to be 10 feet from the side property line ; a variance of 15 feet, and to allow the dwelling to be 25 feet from the rear line ; a variance of 10 feet . Zoning Ordinance Requirements Pursuant to Section 10 . 4 , all structures shall be located seventy-five (75) feet from the front property line , twenty-five (25 ) feet from the side property line , and thirty-five (35 ) feet from the rear property line . Staff Recommendations This subdivision plat was submitted and approved showing a 30 foot building setback prior to the adoption of the present ordinance on 12/10/80 . This subdivision was zoned R-3 and a 30 foot setback was required . Under the present ordinance this subdivision is zoned RA and requires a 75 foot front setback from the street right-of-way . The existing houses were built prior to the adoption of the present ordinance and were only required to be setback 30 feet from the right-of-way .
