Holet Tax Map : 018 Parcel : 53 Zoned : RA Existing Activity Single Family Dwelling Proposed Variance The applicant requests relief from section 10 . 4 of the Albemarle County Zoning Ordinance to allow a single-family dwelling to be located 20 . 2 feet from the side property line ; a variance of 4 . 8 feet . Zoning Ordinance Requirements Pursuant to Section 10 . 4 , all structures shall be located twenty-five (25 ) feet from the side property lines . Staff Recommendations Upon making a footing and zoning inspection , the inspector found that the footings met the setback requirements . Stakes were in place on the side property line adjacent to where the structure was to be located . When a final survey was done the structure was shown on the plat as being too close to the side property line . February 13 , 1981 Mr. and Mrs. Kenneth M. The purpose of this letter is to waive the side, line setback requirements with respect to your house. Elk Run Corporation, the developer of Windrift Subdivision hereby waives , as to the above-captioned house and lot, the sideline setback requirement contained in paragraph 3 , entitled Building Lines, of the Windrift Declaration of Restrictive Covenants dated July 11, 1977 , recorded in the Clerk' s Office of the Circuit Court of Albemarle County, Deed Book 625, Page 172 .
