Tax Map : 061W2 Parcel : O1 -F3 Zoned : R- 1.0 Existing Activity Townhouse Proposed Variance The applicant requests relief from section 17 . 3 of the Albemarle County Zoning Ordinance to allow a townhouse to be located 19 . 99 feet from the rear property line ; a variance of . 01 feet . Also requests relief from section 17 . 3 to allow a townhouse to be located 9 . 78 feet from the front property line ; a variance of 15 . 22 feet . Zoning Ordinance Requirement Pursuant to section 17 . 3 , all structures shall be located twenty (20) feet to the rear property line and twenty-five (25 ) feet from the front property line . Staff Recommendations Prior to the adoption of the present ordinance (adopted 12/10/80 ) this subdivision which was zoned R-3 required a ten ( 10) foot setback from the front property line , which was recorded on the site plan and the recorded plat . The present ordinance (adopted 12/ 10/80) requires a twenty-five (25) foot setback from the front property line . Since this subdivision was platted and recorded prior to the present ordinance , the staff must recommend approval .
