The applicant requests relief fromsection 10 . 4 of the
Albemarle County Zoning Ordinance to allow a dwelling
to be located thirty (30) feet from the front property
line ; a variance of forty- five (45 ) feet .
Zoning Ordinance Requirement
Pursuant to section 10 . 4 , all structures shall be located
seventy-five (75 ) feet from the front property line .
Staff Recommendations
This subdivision plat was submitted and approved showing
a 30 foot building setback prior to the adoption of the
present ordinance on 12/10/80 . This subdivision was zoned
R- 3 and a 30 foot setback was required . Under the present
ordinance this subdivision is zoned RA and requires a 75
foot front setback from the street ri:ght--of-way. The
existing houses were built prior to the adoption of the
present ordinance and were only required to be setback
30 feet from the ri'ght-of-way., Based on these facts ? the
staff recommends approval .
