Gercke Land Company , Inc . Tax Map : 045 Parcel : 11K Zoned : RA Existing Activity Vacant Lot Proposed Variance The applicant requests relief from section 10 . 4 of the Albemarle County Zoning Ordinance to allow a dwelling to be located 30 feet from the front property line ; a variance of 45 feet . Also the applicant requests relief from section 10 . 4 for the dwelling to be located 15 feet from each side property line ; a variance of 10 feet for each side property line . Zoning Ordinance Requirement Pursuant to section 10 . 4 , all structures shall be located seventy-five (75) feet from the front property line and twenty- five (25 ) from the side property lines . Staff Recommendations This subdivision plat was submitted and approved showing a 30 foot building setback prior to the adoption of the present ordinance on 12/10/80 . This subdivision was zoned R-3 and a 30 foot setback was required . Under the present ordinance this subdivision is zoned RA and requires a 75 foot front setback from the street right-of-way. It also requires 25 feet from the side property lines . The existing houses were built prior to the adoption of the present ordinance and were only required to be setback 30 feet from the right-of-way and 10 feet from the side property line . Based on these facts , the staff recommends approval .
