Visepong Punyanitya Tax Map : 061W2 Parcel : O1 -F6 Zoned : R- 10 Existing Activity Townhouse Proposed Variance The applicant requests relief from section 17 . 3 of the Albemarle County Zoning Ordinance to allow a townhouse to be located 9 . 74 feet from the side property line ; a varinace of . 26 feet . Zoning Ordinance Requirement Pursuant to section 17 . 3 , all structures shall be located ten ( 10 ) feet from the side property line . Staff Recommendation This subdivision was platted and recorded prior to the adoption of the 12/10/80 ordinance , which required ten ( 10 ) feet from the side property line . The section in which this variance is applied under is in the present ordinance (adopted 12/10/80) . The applicant could not apply under an ordinance which no longer is in existance . Therefore , they had to apply under the present ordinance , which requires the same distance from the side property line . Therefore , the staff recommends approval .
