Eglinton Investment Company Tax Map: 057 Parcel : 81Q, 104, 105, part of Zoned: RA Existing Activity Vacant Lots Proposed Variance The applicant requests relief from section 10.4 of the Albemarle County Zoning Ordinance to allow a lot of 1 .469 acres; a variance of .531 acres. Zoning Ordinance Requirement Pursuant to section 10.4, the minimum lot size is two (2) acres. Staff Recommendations The owner contacted the Planning Department in the summer of 1980 about building a swimming pool for the homeowners in Ivy Woods Subdi- vision. The zoning ordinance at that time required 2 acres for single family dwellings, but did not specifically mention the area requirements for other uses. On December 10, 1980, a new zoning ordinance was adopted requiring a minimum of 2 acres in the RA zone (replaced old A-1 zone) regardless of the use. The owner proceeded in good faith and got caught by the new ordinance and the staff recommends approval with the following conditions: (1 ) Health Department approval of sanitary facilities (2) Note on the plat: Lot X is not to be used for residential purposes. (3) County Attorney approval of revised maintenance agreements The above conditions must be met before staff approval of plat. Keeler, Assistant Director of Planning 4' Date: April 27, 1981 Re: VA-81-33 Joseph Kelly Joseph Kelly is seeking a variance from the area requirements of the RA zone. This memo is intended to provide you with a background for this case. Last summer, Mr. Kelly contacted this office as to the requirements for a swimming pool primarily for the use and under the control of the homeowners in Ivy Woods subdivision. The homeowners desired to acquire the smallest permissible tract of land for that purpose. At that time, the A-1 zone required a minimum of 2 acres for a single-family dwelling, but was unclear as to area requirements for other uses. It was felt that a minimum of 60,000 square feet could be approved by the Commission for the swimming pool. Mr. Kelly negotiated with the developer on this basis. In December, 1980, the Board adopted the new zoning ordinance which requires a minimum lot size of two (2) acres in the RA zone regardless of intended use. The Ivy Woods homeowners having negotiated on the basis of 60,000 square feet were caught by the new ordinance. While this may or may not be deemed a hardship, I felt it appropriate to advise the Board of Zoning Appeals that Mr. Kelly had proceeded under the provisions of the old ordinance with frequent contact with this office in an effort to forward the swimming pool proposal through the County approval process.
