Proposed Variance
The applicant requests relief from Section 10.4 of the Albemarle County
Zoning Ordinance to allow a dwelling to be located 45 feet from the front
property line, a variance of 30 feet. The applicant also requests relief
from Section 10.4 to allow a dwelling to be located 25 feet from the side
property line, a variance of 35 feet.
Zoning Ordinance Requirement
Pursuant to Section 10.4, all structures shall be located a minimum of
seventy-five (75) feet from any street, road, or access easement. Pursuant
to Section 4.6.3.2, other yards adjacent to streets shall have a minimum
width or depth, as the case may be, of eighty (80) percent of the minimum
front yard depth required in the district in which the lot is located.
This provision shall apply to lots in the RA or residential districts only.
Staff Recommendations
The topography of the lot and location of the stream will affect the
building site and septic system. The staff recommends approval of the
variance, providing no structure be located on slopes of twenty-five
(25) percent or greater and subject to Health Department approval .

All taxes, interest, insurance, rents, FHA and other escrow deposits, if any, shall be pro-
rated and adjusted to date of settlement.
Settlement shall be made on or before Ju 1 y 15, 1981 , 19 , or as soon thereafter
as title can be examined and papers prepared, allowing a reasonable time to correct any defects
reported by the title examiners.
It is understood that title is to be free and clear of all liens and indebtedness of every kind
except those mentioned above.
