Proposed Variance
The applicant requests relief from Section 2.6.2 of the previous
Albemarle County Zoning Ordinance to allow a single-family
dwelling, which was built under the previous Zoning Ordinance, to
be located 15.66 feet from an access easement; a variance of 14.34
feet.
Zoning Ordinance Requirement
Pursuant to Section 2.6.2 of the previous Albemarle County Zoning
Ordinance, the side yard on the side facing the side street shall
be thirty (30) feet or more for both main and accessory buildings.
Staff Recommendation
Recommend approval for proper setback from the easement to serve
the rear lot.
