Ednam Corporation Tax Map: 060 Parcel : 28A Zoned: PRD/R-4 Existing Activity Planned Residential Development under construction Proposed Variance The applicant requests relief from Section 30.5.2,2 of the Albemarle County Zoning Ordinance to allow a security guard house to be located 90 feet from the right-of-way of Rt, 250 West, a scenic highway; a variance of 60 feet. Zoning Ordinance Requirement Pursuant to Section 30,5,2,2, SA-highway overlay districts are established along scenic highway corridors in Albemarle County for a distance of one hundred fifty (150) feet on each side of the right-of-way, Staff Recommendation The structure would have to be located at entrance, being the proposed use. Market Street Charlottesville, VA 22901 Re: "Ednam" Zoning Variance for Security Guardhouse Dear Mr. Evans: The subject request for a variance to locate a security guardhouse not closer than 90 feet to the property line along U.S. 250 is a variance of 60 feet from the 150 feet scenic highway setback. The hardship is imposed by the zoning ordinance itself in two regards. it The scenic highway setback required by the Zoning Ordinance in its application has created a 5.6 acre open space along U.S. 250, which represents sixteen percent of the 35.4 acre site. The requirements of an approved highway entrance further necessitated placement of the interior loop road to permit stacking of cars exiting onto U.S. 250. These factors plus the concept of security for "Ednam" combine to establish the location of a guard house or gate house at the intersection of the entrance road and the interior loop road. Considering variances given along U.S. 250 in this general area, including the last office building in the Village Green of Ednam Forest, the location of this accessory structure in compatible with the area and the intent of the ordinance. As a part of a designed and landscaped entrance involving stone walls, the gate house is part of the entrance, though technically defined by the Zoning Ordinance as a structure. As the result of the entrance design, the topography and landscaping combine with the gate house to produce a subdued or not highly visible entrance which presents no conflict with public health, safety or welfare. Indeed the security pro- vided furthers these objectives of the Zoning Ordinance. There is furthermore no conflict with the visual intent of the Scenic Highway ordinance. Sincerely, Sqtam1Wz Sandy H.
