Additional comments or conditions may be added or eliminated based on further review.): [Each comment is preceded by the applicable reference, which is to the Subdivision/Zoning Ordinances unless otherwise specified.] NOTE: This final subdivision plat requires a `preliminary plat exhibit' because no preliminary plat was previously approved. A second submission was not provided for the `preliminary plat exhibit' despite comments having been specified for that exhibit because information was not provided, or incorrectly provided, in the first submission of the exhibit. However, a final site plan is also under review for this same phase and layout. Therefore, for the purpose of these comments the submission of SDP2018-59 Belvedere Phase IVA-1 Final Site Plan (revision date 12 28118) has been used in place of the 2" d submission of the preliminary plat exhibit. Rev. 2: Note still applies for the 3'd submission of the preliminary plat. [14-302(A)14, 14-303(C)] 14-303(G), 14-317] Dedication of open space; Boundary lines; Instrument evidencing maintenance of certain improvements. It has been noted that the open space and alleys will be dedicated to, and maintained by, the Belvedere HOA. Address the following: d) Submit an instrument assuring the perpetual maintenance of the alleys, the stormwater management facility, the open space areas, and any other improvements that are to be maintained by the HOA in perpetuity. County Attorney approval is required prior to final plat approval. Rev. 1: Comment not yet fully addressed. A supplemental declaration has been submitted that covers these required improvements and area. Please address the following: i. Revise the Phase IVA-1 supplemental declaration to have the correct acreage for the open space that is specified in section 5.a. of the document. The size for the proposed open space is shown as 2.184 AC. on sheets V5 & V6 and not 1.934 Ac. ii. The private storm drainage easements are included in the Phase IVA-1 supplemental agreement. Therefore, no additional legal document needs to be submitted for the "private" storm drainage easements. iii. The two "public" storm drainage easements shown on the proposed plat will be recorded with the Phase IIB subdivision plat, dedicated to public use with the Phase IIB drainage easement legal document (template provided to applicant with Phase IIB comments on 2/27/19), and must be shown as "existing" on the next submission of this Phase IVA-1 plat since it is the reviewers understanding that Phase 11B plat and documents will be recorded prior to this plat. Therefore, no document needs to be provided for Phase IVA-1 in reference to the "public" drainage easements. Rev. 2: Comment not vet fully addressed. Address the following: i. On Sheet No. V2 an "existing private storm drain easement" is shown at the intersection of Fowler Street and Cornelius Alley. On the last submission of Phase IIB that easement was changed to be a "public" easement. Update the plat in order to show this change. ii. A public storm drainage deed of easement was submitted for review with this plat. Since all "public" drainage easements are being created with the Phase IIB plat the deed for "public" drainage is not required with the Phase IVA-1 plat. iii. A signed and notarized copy of the Phase IVA-1 supplemental declaration must be submitted to the County prior to approval of the final plat. The declaration must be recorded with the plat. [14-311] Infrastructure improvement plans. All infrastructure required to construct phase IVA shall be reviewed, approved, and built or bonded before the final plat can be approved. This includes all offsite improvements required to serve the development, including road plans, WPO plan, water and sewer connections which are part of phase IIB. Rev. 1: Comment still valid. On the plat depict, dimension, and label all drainage easements as either public or private. Rev. 1: Comment not yet fully addressed. Address the following: a. Revise the storm drainage easements to match those shown on the WPO that is being amended and the most recent submission of the Phase IVA-1 final site plan. b. Ensure that all references to the drainage easements that will be created with the Phase IIB plat are updated to address comments provided for that plat, such as portions of private storm drainage easements that are within the private alleyways, do not include any public storm drainage, and are incorrectly labeled on both the Phase IIB and this plat as "public". c. On sheet V2 there are two "public" storm drainage easements at the intersections of the roads that are not shown even though they are shown on later sheets. Show those easements on those sheets. d. Since there will not be any "public" proposed drainage easements, or stormwater maintenance easement, on this plat once it has been revised remove Note #14 from the cover sheet V1. Rev. 2: Comment not vet fully addressed. The WPO for this portion of Belvedere has not Vet been approved. Once that WPO is approved, ensure that this plat matches the easements shown in that plan. If necessary, revise the storm drainage easements to match those shown on the WPO that is being amended and the most recent submission of the Phase IVA-1 final site plan. See engineering comments. 35. [14-317] Instrument evidencing maintenance of certain improvements. Provide the legal documents that will be required for the ownership and maintenance of the private alleys and open space. These documents will be reviewed by the County Attorney's office. These legal documents must be approved by the County, signed and notarized, and a copy provided to the County prior to final plat approval. These documents must be recorded with the final plat. Rev. 1: Comment not yet fully addressed. See comment #3 above in reference to maintenance of the open spaces. All alleys will be created with Phase IIB plat, and the legal documents in reference to the maintenance of the alleys is being reviewed with that plat. Rev. 2: Comment not vet fully addressed. All deeds and declarations must be sianed. notarized and submitted to the planning reviewer prior to approval of the final plat. These documents must be recorded with the final plat. 39. [Comment] This final plat will not be approved until the final road plan is approved and the alleys are built or bonded.
