Proposed Variance
The applicant requests relief from Sections 30.5.2.2 and 30.5.6.2. 1 of the
Albemarle County Zoning Ordinance to allow the construction of a two-bay
detached garage accessory addition 24 feet from the Rt. 250 West (scenic
highway) right-of-way, a variance of 126 feet. Applicant also seeks relief
from Section 30.5.6.2.2 of the Albemarle County Zoning Ordinance to allow
parking within the 50-foot setback requirement. A total relief from this
Section is requested.
Zoning Ordinance Requirement
Pursuant to Section 30.5.2.2, SA-highway overlay districts are hereby
established along the following highway corridors in Albemarle County
for a distance of one hundred fifty (150) feet on each side of the right-
of-way: a. U.S. Route 250 from the western corporate limits of the City
of Charlottesville to the western Albemarle County border. Pursuant to
Section 30.5.6.2. 1 , no buildings or structures other than necessary accessory
appurtenant fences and/or walls, except as hereafter provided in the case of
certain signs , shall be constructed within any SA-highways or overlay district.
Pursuant to Section 30.5.6.2.2, no off-street parking or loading shall be
allowed closer than fifty (50) feet to the right-of-way line of a SA-highway
which is all or part of off-street parking facilities required or designated
to accommodate more than two (2) motor vehicles.
Staff Recommendations
The 2. 15 acre parcel has a business (gas station) on frontage of Rt. 250 West,
and to the rear portion is residential . The proposed addition will be in line
with the existing building (gas station) . There are alternatives available
for this location of the addition, but practicality and physical location
would have to be considered. Staff feels that a variance is warranted, but
the applicant should show to Board the degree which they should consider.
