Earlysville Forest Land Trust Tax Map: 031B Parcel: 18 Zoned: PUD/RA Existing Activity Residence Proposed Variance The applicant requests relief from Section 20.8.6 of the Albemarle County Zoning Ordinance to allow a single-family dwelling to be located 17 feet from the rear property line; a variance of 3 feet. Zoning Ordinance Requirement Pursuant to Section 20.8.6, all structures to be located on the outer perimeter of a PUD district shall conform to the setback and yard regulations of the adjoining district. Within the PUD district, the Board of Supervisors shall establish minimum setback and yard require- ments at time of establishment of such district. Staff Recommendations When the footing inspection was made, the lot was not checked to be a corner lot and, at the same time, the contractor took the same line to be a side line also. We feel that the error was made honestly by both parties. The variance will not affect an adjoining lot because the lot in question adjoins common area. We recommend approval.
