I need a clarification of what items that will be sold that is re- lated to a country store. In your letter you are proposing that items will be sold through the catalog and other general hardware articles will be sold as an accessory to the catalog sales. This is not the intent of the Zoning Ordinance. Under section 16-35 of the Zoning Ordinance-, a general store, country, is defined as: "a single store, the ground floor area of which is four thousand (4,000) square feet or less and which offers for sale primarily, most of the following articles: candy, papers and magazines , and general hardware articles. With specific approval through the special use permit process, gasoline may also be offered for sale, but only as a secondary activity of a country general store and no more than three (3) gasoline pumps shall be permitted. - The special use permit approved by the Board of Supervisors was for a country store and not a catalog sales. However, a catalog sales can be an accessory use to a country store. The intent of the catalog sales is that items pertaining to a general store, which are not available at the site, can be ordered through a catalog. have visited many country stores and found that they have boots , some clothing and general hardware items that you would normally find in a country store, but as an accessory to a country store. In section 16-2 of the Zoning Ordinance, an accessory use of structure is defined as a subordinance use or structure customarily incidental to and located upon k I r November 13, 1979 Joseph W. In summary, I would like to say that the catalog sales was not the main use that was approved by the Board of Supervisors. Therefore, this can only be an accessory use. Ewald, Jr - The Very Thing Tax Map: 55 Parcel : 19C Zoned: RA EXISTING ACTIVITY Retail Store & Mail Order Catalog PROPOSED VARIANCE The applicant requests relief from Sections 30.5.6.2. 1 & 30. 5. 7. 2, to allow two (2) free-standing signs to be erected one (1) foot from the highway right-of-way. The applicant requests relief from Section 30.5. 7.2, to allow a total of two (2) free-standing signs with a total of thirty-two (32) square feet in area to be erected; a variance of one (1) free-standing sign with area of sixteen (16) square feet. ZONING ORDINANCE REQUIREMENT Pursuant to Section 30.5.6.2. 1 , no buildings or structures other than necessary accessory appurtenant fences and/or walls, except as hereafter provided in the case of certain signs, shall be constructed within any SA-highway overlay district. Section 30. 5. 7.2 states that free-standing business and projecting business signs shall be limited to ten (10) feet in height above grade, eighteen (18) square feet per single sign face, and to one (1) sign per separate highway frontage. STAFF RECOMMENDATION The elevation of the entrance road to the site, and the growth which adheres this entrance constitutes a need for locating the sign closer to the highway right-of-way. The actual need for two sign locations; we question. The staff would recommend approval for the setback amount, but not the need for two (2) sign locations.
