PROPOSED VARIANCE
Applicant requests relief from Section 6.5.01 , to allow a room addition
to be located thirty-three (33) feet from the front property line; a
variance of two (2) feet.
ZONING ORDINANCE REQUIREMENT
Pursuant to Section 6.5.01 of the Albemarle County Zoning Ordinance, in
the case of any sudivision which was approved pursuant to Chapter 18 of
the County Code prior to the adoption of this ordinance and which was of
record at the time of the adoption hereof, the rear, side and front yard
setback regulations of the Zoning Ordinance in effect at the time of such
approval shall apply to all lots within such subdivision.
STAFF RECOMMENDATION
The applicants lot was approved in October, 1980, with a 35 foot setback
on the front abutting the dedicated right-of-way. The present setback
in the R-10 zone allows a 25 foot setback on front. We feel that if
applicant can show physically why that the present setback line needs
to be exceeded, a favorable recommendation would be in order. The 2 foot
allowance would not, in our opinion, have any affect on adjacent properties,
