Ronald & Alberta Dodson Tax Map: 071 Parcel : 11A Zoned: RA EXISTING ACTIVITY Single-Family Dwelling PROPOSED VARIANCE The applicant requests relief from Section 4.6.2.2 of the Albemarle County Zoning Ordinance to allow a patio addition to be located 47 feet from the right-of-way; a variance of 13 feet. ZONING ORDINANCE REQUIREMENT Pursuant to Section 4.6.2.2, on corner lots, the front shall be construed to be the shortest boundary fronting on a street. Also, pursuant to Section 4.6.3.2, other yards adjacent to streets shall have a minimum width or depth, as the case may be, of eighty (80) percent of the minimum front yard depth required in the district in which the lot is located. STAFF RECOMMENDATION The right-of-way that the addition would encroach serves seven (7) parcels at the present. The location of the house was established under lesser setback requirements. The house has an entry to the front and on the end where the addition is proposed. If the board wishes to grant the variance, we would ask that it be conditional that if the patio were enclosed in the future it would not constitute any additional need for a future variance for encroachment of the setback requirement.
