TAYLOR, husband and wife, parties of the first part, and RALPH E. MAIN, JR. of Charlottesville, Virginia and THOMAS H. OXENHAM, JR. of Richmond, Virginia, Trustees, parties of the second part, WITNESSETH That for and in consideration of the sum of TEN DOLLARS ($10.00) cash in hand paid and other good and valuable considera- tion, the receipt of which is hereby acknowledged, the parties of the first part do hereby GRANT, BARGAIN, SELL and CONVEY with GENERAL WARRANTY OF TITLE unto the parties of the second part, Trustees, the following described property, to-wit: All that certain tract or parcel of land with the improvements thereon and the appurtenances thereunto belonging lying a short distance northeast of State Route 620 about 2.5 miles southeast of Slate Mill in the Scottsville Magisterial District of Albemarle County, Virginia, containing 32.072 acres, and more particularly described on a plat of survey made by R. O. Snow and Associates, C.L.S. , dated April 15, 1977 and recorded in the Clerk's Office fthe n Circuit Virginia Court of Albemarle County, Book 618 at Page 231, and beingwtsthe csame eyed property in all respectswhich unto the parties of the first part by deed of Donald R. Johnson et ux dated November 18, 1981 and recorded inrecediforesaiLdClerk's Office immediately p of trust. THIS CONVEYANCE IS UPON A TRUST, NEVERTHELESS, to secure a debt due and owing by the parties of the first part described as follows: $14,800.00 payable to the order of Donald R. Johnson and Dianna I. Johnson, or survivor, bearing interest at the rate of 10% per annum, payable in 120 consecutive equal monthly in- 7:::K 73 i3NOV stallments of principal and interest, each in the amount of $195.60, commencing January 1, 1982 and continuing on the first day of each month thereafter until paid in full. The parties of the first part hereby agree as to the debt secured that the following provisions will apply to said debt and this deed of trust securing it: EXEMPTIONS WAIVED; SUBJECT TO CALL UPON DEFAULT; ANY TRUSTEE MAY ACT; SUBSTITUTION OF TRUSTEES PERMITTED; RIGHT OF ANTICIPATION RESERVED; INSURANCE REQUIRED IN AMOUNT EQUAL TO INSURABLE VALUE OF IMPROVEMENTS. In the event of foreclosure proceedings under this deed of trust, advertisement of the time, place and terms of sale shall be by publication for not less than once a week for four successive weeks in a newspaper published or having general circulation in the County, Town or City in which the property is located, but this provision shall not be construed to prevent such additional adver- tisement as the Trustees may deem advisable. It is understood and agreed upin that the parties of the first part herein hereby assume all of the covenants, duties and obligations imposed by Sections 55-58 through 55-66 of the code of • Virginia, 1950, as amended, and that the Trustees herein and the beneficiaries hereunder shall have all of the rights, powers and securities conferred by said Act, and that said Act shall control in the construction and execution of this deed of trust in all respects, unless herein expressly otherwise provided.
