On January 8, 1980, during the regular meeting of the Albemarle '
County Board of Zoning Appeals, your application for VA-79-84 was
denied. This request sought relief from section 18-3-2 of the Albemarle
County Zoning Ordinance to allow a projecting sign to be located one (1 )
foot from the right-of-way.
l On January 9, 1980, you applied for a variance to install two (2)
walls signs to be located above the eave lines of the roof and totaling
thirty-five (35) square feet in size.
After Mr. Robert Vaughn, Zoning Administrator, and myself visited
the site and discussed this matter with you, you decided to withdraw
your application.
a Your wife wrote me a letter stating that you all have decided to E
install a wall sign in compliance with the Zoning Ordinance requirements.
This was almost two months ago, and you still have not removed the pro-
i jecting sign.

1 You have until March 11 , 1930, to remove the projecting sign and
comply with the Zoning Ordinance or I will proceed with the necessary
legal remedies.

PROPOSED VARIANCE
The applicant requests relief from Section 30.5.6.2. 1 of the Albemarle
County Zoning Ordinance to allow a 12 square foot freestanding sign to
be located five (5) feet from the highway right-of-way; a variance of
45 feet. The applicant also requests relief from Section 30.5.7. 1 to
allow a 12 square foot directional sign to be located five (5) feet
from the highway right-of-way; a variance of 25 feet.
ZONING ORDINANCE REQUIREMENT
Pursuant to Section 30.5.6.2. 1 , no buildings or structures other than
necessary accessory appurtenant fences and/or walls, except as hereafter
provided in the case of certain signs, shall be constructed within any
SA-highways overlay district. Pursuant to Section 30.5.7. 1 , notwithstanding
provisions of Section 30.5.6.2. 1 , the following types of signs, as further
limited in Section 30.5.7.2, shall be permitted within fifty (50) feet of
the right-of-way of the scenic highway but not within the required front
yard as regulated for the underlying district: Directional sign (etc. )
STAFF RECOMMENDATIONS
The physical location of the building is adjacent to the highway right-of-
way. Because of the location of the building a free-standing or projecting
sign would be more visible to oncoming traffic from both east and west. We
do find the need for a 12 foot directional sign dubitable. We can only
recommend approval of the setback of the business sign.
