Tor Tax Map: 058 Parcel : 84D Zoned: C-1 EXISTING ACTIVITY Vacant Restaurant Building PROPOSED VARIANCE The applicant requests relief from Section 30.5.6.2. 1 of the Albemarle County Zoning Ordinance to allow a free-standing sign to be located 6 feet from the highway right-of-way; a variance of 44 feet. The applicant also requests relief from Section 30.5.7.2 to allow the free-standing sign to be 36 square feet aggregate area; a variance of 18 square feet. ZONING ORDINANCE REQUIREMENT Pursuant to Section 30.5.6.2. 1 , no buildings or structures other than necessary accessory appurtenant fences and/or walls, except as hereafter provided in the case of certain signs, shall be constructed within any SA-highways overlay district. Pursuant to Section 30.5.7.2, (b) Free- standing and projecting business signs shall be limited to ten (10) feet in height above grade, eighteen (18) square feet per single sign face, and to one (1) sign per separate highway frontage. STAFF RECOMMENDATION The site has an existing brick planter approximately 10 feet from the highway in which three (3) metal supports are. These supports were used for a sign some years ago, and now the applicant proposes to use it to mount his sign. The staff finds only this to be the uniqueness of this variance. We only wish to speak favorable on the use of the already existing support. The property does have visibility from both east and west bound traffic.
