Wayne and Deborah Hall Tax Map: 046 Parcel: 103 Zoned: RA EXISTING ACTIVITY Single-Family Dwelling PROPOSED VARIANCE The applicant requests relief from Section 10.4 of the Albemarle County Zoning Ordinance to allow a single-family dwelling to be located 51.89 feet from the right-of-way; a variance of 23. 11 feet. ZONING ORDINANCE REQUIREMENT Pursuant to Section 10.4, all structures shall be located seventy-five (75) feet from the front property line or access easement. STAFF RECOMMENDATION The applicant obtained a permit first to remodel an existing house in 1981. Second, they obtained a building permit in 1982 to construct a second dwelling on the parcel. Now they are asking for a variance for setback from an easement they want to establish to serve the dwelling at the rear of the property. We find that the topography of the lot would warrant the need for an exception.
