PROPOSED VARIANCE
The applicant requests relief from Section 4.12.6.5 of the Albemarle County
Zoning Ordinance to allow 53.41 feet between curbs in a parking lot; a variance
of 7 1/4 inches or .6 foot.
ZONING ORDINANCE REQUIREMENT
See attached copy of Section 4.12.6.5 of the Zoning Ordinance.
STAFF RECOMMENDATION
The Planning Commission approved the site plan for the applicant on April 25,
1978. The plan that was approved indicated the measurement to be 53 feet.
This was an oversight, and should have been the required 54 feet. We find
the applicant's request justifiable and recommend approval.

Dear Larry,
Enclosed please find a copy of a zoning inspection report prepared by
R. A. Shaw, Senior Zoning Inspector. The report is submitted in response
to the concern over the possible zoning violation created by the width of
the parking lot at the above referenced site. Nr. Shaw and John Greene made 11
an inspection of the site and measured the width of the parking areas on
July 20, 1982.
As we have discussed previously, the site plan approved in May, 1978
showed a distance between curbs of 53 feet. Evan though the plan was approved,
the distance between curbs did not meet the terms of the Zoning Ordinance
(minimum 54 feet required) at the time.
It appears from Mr. Shaw's report that most of the parking lot has been
constructed in accordance with the ordinance but that the east side of Building
Y is 8 inches short of compliance. You should contact Mr. Robert Vaughn,
Zoning Administrator, for a determination of whether this constitutes a
violation and if you must seek a variance.
The parking area around Building "Z" must also be constructed to the
minimum standard required in the ordinance. The plan has been amended to
show the correct dimensions but the reference to the original site plan must
be removed. Though the dimensions are not drawn to scale we can approve the
plan with the correct dimensions noted. Also, please he advised that the
amended building design can be approved administratively when the above-noted
correction is made on the plan.

Approximately 20 of the 148 parking spaces privided were bffflt with 53.A' between or46
curbs. Although this complies with the approved Site Plan, the Zoning Ordinance requires
a minimum of 54' from curb to curb. All other spaces constructed to date and all spaces to
be constructed will comply with the Zoning Ordinance. A variance is requested for those
few sites that are slightly short. The total number of parking places required is 128.
Therefore, the requested variance is for spaces provided is addition to those required.
