PROPOSED VARIANCE
The applicant requests relief from Section 26.10.2 of the Albemarle County
Zoning Ordinance to allow an addition to be located 85 feet from the rear
adjoining R-1 property; a variance of .15 feet.
ZONING ORDINANCE REQUIREMENT
Pursuant to Section 26.10.2 of the Albemarle County Zoning Ordinance,
adjacent to residential districts: No portion of any structure, except
signs advertising sale or rental of the property, shall be located closer
than fifty (50) feet to any agricultural or residential district and no
off-street parking space shall be closer than thirty (30) feet to any
agricultural or residential district. For the heavy industry (HI) , no
portion of any structure, except signs advertising sale or rental of the
property, shall be located closer than one hundred (100) feet to any
agricultural or residential district and no off-street parking shall be
closer than thirty (30) feet to any residential district.
STAFF RECOMMENDATION:
On June 15, 1982, the Board granted a variance for an addition to be
located 88 feet from the property line; a variance of 12 feet. The
applicant comes back before the Board asking that a variance of 15 feet
be granted so that the addition will be 85 feet from the residential
property. The additional footage is needed because of an error in
measurement. We recommend approval.
