Proposed Variance
The applicant requests relief from Section 6.5.01 of the Albemarle County
Zoning Ordinance to allow an addition to be located 20 feet from Peach Tree
Drive; a variance of 10 feet.
Zoning Ordinance Requirement
Pursuant to Section 6.5.01, in the case of any subdivision which was approved
pursuant to Chapter 18 of the County Code prior to the adoption of this ordi-
nance and which was of record at the time of the adoption hereof, the rear,
side and front yard and setback regulations of the Zoning Ordinance in effect
at the time of such approval shall apply to all lots within such subdivision.
Staff Comments
The existing residence has now an enclosed addition which was added after the
original house was built. If the proposed addition could be added without
disturbing the septic system at the rear of the house, there would be no need
for the variance. Provisions for the present ordinance adopted on December 10,
1980, (Section 4.6.3.2), would allow an eighty percent of minimum front yard
setback, with the figure being 24 feet.
