Evans Deputy Zoning Administrator 401 McIntire Road, Room 2-2 Charlottesville, VA 22901-4596 Dear Mr. Evans: My wife and I are appreciative of the fact that you have written us a letter announcing a public hearing by the Board of Zoning Appeals on April 12 as requested by Robert F. and Joanne C. Niehaus. Without notification by your letter we would not have known about this hearing. As adjoining landowners of Lots 3 and 4 in Clover Hill, we are opposed to the requested variance of 25 feet which would move the proposed building o Parcel 45B to within only 35 feet of Manor Road. We are opposed to such a variance for the following reasons: 1. The plat showing Parcel 45B clearly delineates a building line setback of 75 feet from Route 844 and 60 feet from Manor Road. This setback was approved and sealed by the County Planning Commission Chairman, th County Board of Supervisors Designated Agent and the owner, 0. F. Fitzgerald, December 14, 1981. The County Zoning Ordinances have been designed and approved by our Planning Commission and Board of Supervisors to lend a semblance of commonality of land use, building location and development in the County and most importantly to protect adjoining landowners rights and their property from devaluation that might result through indiscriminate land use. On this basic premise alone, we object to the requested variance. Furthermore, we object to the variance because, if granted, it can ser olsly threaten the use and value of our Lot 3 as a home building site. 2. The proposed building on Parcel 45B will be directly opposite our Lot 3. The proposed building will front Route 844 which will place the side of the building toward Manor Road. Such a building location is incongruous with all existing and proposed buildings on Manor Road, including Lot 3, as such houses now front and will front Manor Road. As you know the land in the rear of houses are used for storage houses, garbage cans and such eyesores that one wishes to hide from his front yard. Such an appearance will serve to devalue our Lot 3, as such a scene will be viewed from the house on Lot 3. 3. If the variance is granted for the proposed building on Parcel 45B, the building will be only 85 feet from the front boundary of Lot 3 indicating that the septic field will be 85 feet, or possibly much less depending upon the spread of the field, which threatens the opportunity for us to locate a well on Lot 3. We have been informed by the Albemarle Health Department that all wells must be 100 feet from septic drain fields. Further, for every 5% slope above a 10% slope, the well has to be another 25 feet from the drainfield. The RECEIVED . 1983 Now vow -2- proposed building site on Parcel 45B is on top of a knoll that I estimate to be 4 feet higher than the front of Lot 3 and sloping toward Lot 3. Since Lot 3 is only 200 feet deep, locating a well on Lot 3 100 feet from a septic field on Lot 3 and 100 feet from a septic field on 45B could be an impossible task that would render our property useless for a house site. When the Niehaus's purchased Parcel 45B, they purchased with the full knowledge that: (1) specific building setbacks were required because the lines are clearly delineated on the registered plat, and (2) they certainly walked over the parcel before purchasing, so they had to know the topographical features and how the land would lend itself to supporting the house they wished to build. Thus, they must have been fully satisfied with all facts and conditions because they drilled a well immediately; not unless there was an intent to request a variance hoping you the Board would be sympathetic to their created dilemma. However it may be, if they cannot abide with the stipulations as the result of fronting on Route 844, may I suggest that they front their house on Manor Road within the 60-foot setback. They will have a minimum depth of 120 feet from the 60-foot line to their back boundary within which to build and to locate their septic field. Such a house location would not threaten our future use of Lot 3. My wife and I have owned Lot 3 about 20 years. It was purchased with no thought of being threatened by a subdivision of Parcel 45. We have paid our County taxes faithfully. We are seeking protection of our rights as property owners as afforded by the County Zoning Ordinances, so our future use and valuation of our Lot 3 will not be intimidated. Zoning Ordinance Requirement Pursuant to Section 4.6.3.2, other yards adjacent to streets shall have a minimum width or depth, as the case may be, of eighty (80) percent of the minimum front yard depth required in the district in which the lot is located. This provision shall apply to lots in the RA or residential districts only. Staff Comments The lot's topography is such that the highest elevation is adjacent to the 60 foot building line and beyond. Even so, the overall slope of the lot could accommodate asuitable building site pass the 60 foot building line.
