Mrs. Earl R. Andrew, Etal. Tax Map: 022 Parcel: 11A(1) Zoned: RA Existing Activity Single-Family Residence Proposed Variance The applicant requests relief from Section 10.4 of the Albemarle County Zoning Ordinance to allow a storage shed to be located 8 feet from the front property line, a variance of 67 feet. Zoning Ordinance Requirement Pursuant to Section 10.4, all structures shall be located seventy-five (75) feet or more from the front property line. Staff Recommendations The letter submitted by the applicant explains and tells of the topography of the property. There are alternative places on the property the shed could have been located, but they would not be very aesthetically or conveniently located. The staff feels if the Board wishes to grant the variance that it be conditional upon existing trees to be maintained and/or replaced to provide screening for the structure. 1_,(1-He 110(4n-fain < 'D2t v ct-Ay 0 riiD taNT LawnI Niue August 11 , 1982 Albemarle County Zoning Department 401 McIntire Road Charlottesville, Virginia 22901 Dear Sir or Madam: On behalf of Mrs. Earl Andrew, I hereby request a variance for an existing garden storage shed built on her property at Little Black Mountain on Rt. 641 about four miles east of Rt. 29 North. The shed is a frame building, 7 ' X12 ' , with no electricity or plumbing, situated about 28' from the center of Rt. 641 . The shed was built by Ace Contracting Inc . , where Mrs. Andrew speci- fied, without a moment' s thought to zoning or setback . We accept full responsibility for this oversight and will do whatever is required to comply with the board' s wishes, including, if abso- lutely necessary, moving the building. Following are the reasons we feel a variance should be grante ': (1) Our building is only 67 ' shy of the required setback. Heck, nobody' s perfect. (2) Mrs. Andrew and her sister live at Little Black Mountain. Mrs. Andrew is an elderly widow and her sister is confined to a wheelchair. The shed is ideally situated on a paved path connecting the driveway and the back of the garage. In addition to being close to the drive and their other main storage area (the garage) this area on the pathway is one of the few places near the house that is not on a steep grade. ( 3) As it stands, the shed is surrounded by shrubs and trees that largely conceal it both from the rest of the yard and from Rt. 641. There is no other level site on the property that satisfies the 75 ' setback where the building would not markedly disrupt the extensive and carefully maintained lawns , gardens , and landscaping. (4) The building is completely trapped by trees, shrubs , the well head, a hydrant, a steep bank on the roadside and the house and other shrubbery only twelve feet away on the other side. As small as it is, I'm afraid the building can' t be moved but would have to be dis- assembled and rebuilt at considerable expense to Ace Contracting. If the Zoning Department is willing to grant a variance but feels the building needs to be further shielded from the road we would be willing to do additional landscaping or even build a fence.
