The Albemarle County Board of Supervisors, at its meeting on September 1, 1982,
approved your above-referenced rezoning request, thereby rezoning 7.249 acres
from LI_to HI, on County Tax Map 56, Parcel 67A, White Hall Magisterial District,
subject to the following:
"applicant verbally stated at the meeting that it was his intent that the proffer
limit him to the use of the existing structures which can be renovated as
necessary for his use without expanding the size of the building and subject to
the following conditions which waive the site plan requirerents:
1. Health Department approval. Any kennel washdawn or other animal waste
disposal shall be to a septic system;
2. County Engineer approval of paving specifications for entrance road
and parking area;

(a) It is expressly agreed that, notwithstanding any other provisions of this Sales Contract, Buser shall
not be obligated to complete the purchase of the property or to incur any penalty by forfeiture of earnest
money deposits or otherwise unless Seiler has delivered to Buyer a written statement issued bs the Fc-1-
eral Housing Commissioner setting forth the appraised value of the property for mortgage insurance Ion"

The applicant requests relief from Section 26. 10. 1 of the Albemarle County
Zoning Ordinance to allow a freestanding business sign to be located 2 feet
from the highway right-of-way; a variance of 48 feet. The applicant also
requests relief from Section 26. 10. 1 to allow sign to be located 15 feet
from Parkview Drive; a variance of 35 feet.
Zoning Ordinance Requirement
Pursuant to Section 26. 10.1, Adjacent to public streets: No portion of
any structure, except signs advertising sale or rental of the property,
shall be erected closer than fifty (50) feet to any public street right-
of-way.
Staff Recommendations
The applicant wishes to erect a business location sign for identification
of his business which is located 500+ feet off of Route 240. The structure
from which the business is conducted can not be seen from Route 240. The
closeness of the sign to the right-of-way would provide visibility for east
and west traffic.
We believe the applicant warrants some relief, but recommend to the Board
that a size limitation be imposed for the sign if the variance is granted.
